Shipping Policy
This Shipping and Delivery Policy (the “Shipping Policy”) applies to sales of products or services by Herbaly Marketplace Inc., a Corporation, registered in the Province of Quebec (“Herbaly”), to the user or customer who accesses our Website (as defined in our Terms and Conditions, available here: https://herbaly.com/pages/terms-conditions) to purchase products or goods, and/or access other Services (the “user”/”User”, “customer”, or “you”). Throughout the site and this policy, the terms “we”, “us” and “our” refers to Herbaly. Your purchase of any products or services from the Website is expressly conditioned upon your acceptance of all terms, conditions, policies and notices stated here, and on the Website. This Shipping Policy may reference terms mentioned in our Terms and Conditions, and when such words, phrases or terms are used, they shall have the same meaning as described in the Terms and Conditions.
1. Delivery and Shipping
Deliveries are made to the address indicated by the User and in the manner specified in the order summary. Upon delivery, Users must verify the content of the delivery and report anomalies without undue delay, using the contact details provided in the Terms, or our contact page (available here: https://herbaly.com/pages/contact) or as described in the delivery note. Users may refuse to accept a physical parcel if visibly damaged. Delivery times are specified on this Website or during the purchasing process. Normally all shipments are fulfilled with 1-3 days after they leave our distribution center. However, we are not responsible for shipping times once the shipment is with the carrier, regardless of any time estimates we provide. We are also not responsible for customs/duties/taxes or packages held by customs once shipped. Our sole shipping responsibility shall be to dispatch the Products to the designated shipper, and if requested, provide a shipping receipt to the User, if applicable
2. Failed delivery
Herbaly cannot be held responsible for delivery errors due to inaccuracies or incompleteness in the execution of the purchase order by the User, nor for any damages or delays after handover to the carrier if the latter is arranged by the User. If the Products are not received or collected at the time or within the deadline specified, the Products will be returned to us, and we will contact the User to schedule a second delivery attempt or to agree on the future course of action. Unless otherwise agreed, any delivery attempt starting from the second shall be at the User’s expense.
3. Shipping and Risk of Loss.
Herbaly bears no liability for risk of loss for any Products sold on this Website. Herbaly’s sole shipping responsibility shall be to dispatch the Products to the designated shipper, and if requested, provide a shipping receipt to the User, if applicable. After Herbaly has provided the Products as described on this Website to the shipper, Herbaly shall bear no further liabilities for the condition or arrival of the Products at destination after the goods as described have been taken into the custody of the shipper.
4. Changes to the Policy
We may amend and change this policy at any time, by posting the amended policy on our Website, and making it available to our customers. It is your responsibility to ensure that you are up to date on the most recent policy edition by checking our Website. Any changes to this policy will apply to all orders which are received by us after the change goes into effect.
